Man pleads guilty to child abuse
A Kingfisher man pleaded guilty to two counts of felony child abuse earlier this month.
Tracy Wayne Gardner, 41, was sentenced to five years for each count with all of it except the first 90 days suspended. The sentences will run concurrently.
He’ll spend those 90 days in the Kingfisher County Criminal Justice Center.
As part of the court order signed Jan. 8 by District Judge Paul Woodward, Gardner must also complete 12 sessions of counseling and serve the remainder of his time under supervised probation.
He’ll also have to pay $4,000 in fines as well as other costs, fees and restitution.
Gardner was originally arrested and charged in June 2022 with one count of child sexual abuse and one count of lewd or indecent acts to a child under 16.
He was released on a $25,000 bond soon after his arrest.
According to an affidavit signed by Kingfisher County Sheriff’s Deputy Chuck Countryman, two female victims reported that Gardner had sexually assaulted them.
One victim alleged multiple incidents when she was between the ages of 8 or 9 and 13. The other victim reported a single incident in 2016 when she was 12.
Gardner faced a potential sentence of up to life in prison on the child abuse charge and up to 20 years on the charge of lewd or indecent acts to a child, but agreed to plead guilty to the amended charges.
