Date set for oral arguments in writ of mandumus filing
A date has been set to hear oral arguments in a request by the parents of Mason Mecklenburg for the Oklahoma Supreme Court to step in and force the firing of Kingfisher head football coach Jeff Myers.
Court dockets show oral presentations are to be made at 10:30 a.m. Tuesday, Sept. 26, at the Oklahoma Judicial Center.
Justin and Lyndy Mecklenburg filed an application to assume original jurisdiction and a writ of mandamus with the state’s highest court early last week.
Named as respondents in the brief were Kingfisher Public Schools, Superintendent David Glover, the Oklahoma State Department of Education, Oklahoma State Board of Education and Ryan Walters, the state superintendent of public instruction.
In it, they asked the court to compel the Kingfi sher Board of Education to terminate Myers, who has been named in a federal civil suit filed by their son, Mason Mecklenburg. ( Note: See corresponding story on Page 1.)
The brief also requests the SBOE exercise its authority and implement an interim superintendent at KPS and oversee the termination process “to ensure ‘the health and safety of school children and school personnel while under the jurisdiction of school authorities.’” Myers was not named as a respondent in the petition.
However, Joe E. White and Kate C. White, his attorneys in the civil suit, have filed special entries of appearance on Myers’ behalf in the cause of action.
Myers on Thursday filed a motion to intervene in order to be named as a party in the matter in order for his attorneys to respond.
The docket reflects Sept. 18 as the deadline for the respondents to respond to the petition.
However, Myers has also filed a motion to extend the response deadline as well as a rescheduling of oral presentations.
