KPS board to meet with magistrate

Special meeting Wednesday at federal courthouse; part of settlement conference

A special meeting of the Kingfisher Board of Education has been called for Wednesday morning at the federal courthouse in Oklahoma City.

The meeting is set for 11:30 a.m. at the United States District Courthouse of the Western District of Oklahoma, 200 NW 4th St., Courtroom 201.

The agenda calls for an executive session to discuss the pending civil litigation against Kingfi sher Public Schools, two current football coaches and two former football coaches by Mason Mecklenburg.

The agenda also has an item calling for “discussion and vote to approve or not approve settlement” in the case.

The meeting will be a part of a conference before a federal magistrate and parties for both the plaintiff and defendant will be present.

Mecklenburg filed the suit in late July 2021 alleging a culture of bullying and hazing within the football program.

Also named in the suit were head football coach Jeff Myers, assistant Derek Patterson and now former assistants Blake Eaton and Micah Nall.

An initial settlement offer of $1.5 million to have the lawsuit dropped against the school district - but not the coaches - was voted down by the board of education in March 2022.

Settlement offers presented by the plaintiff since then have risen to $5 million and then $10 million plus other stipulations, which included the firing of Myers.

The $10 million settlement offer was the last one made public by Mecklenburg’s attorneys.

The defense requested a settlement conference in June due in part to mounting legal fees.

The two sides met before a mediator in an alternative dispute resolution (ADR) for eight hours on July 11.

According to a report filed by the mediator, Larry D. Ottaway, there was no settlement to be made at that time.

Eric Janzen, an attorney with Rosenstein, Fist & Ringold, the firm representing the school district, was at Monday’s regular meeting of the board of education.

Janzen met in executive session with all five board members and Superintendent David Glover for just under two hours.

After Monday’s meeting, three board members - President Charles Walker, Vice President Carly Franks and Clerk Brad Wittrock - indicated they’d be attending Wednesday’s meeting.

That would give the board a quorum to conduct any votes on top of calling the meeting to order.
