County discusses suit in closed session

Kingfisher County commissioners held an executive session Monday with Jordan Miller, attorney with Collins, Zorn and Wagner, regarding a pending 2017 lawsuit by Garrick Steven Yost.

The executive (closed to the public) session came at the end of the regular weekly meeting to discuss issues that “would seriously impair the ability of the board and its attorney to properly process and defend the case currently in litigation,” according to the agenda item.

The case involves injuries Yost suffered and damages to his vehicle allegedly due to the county’s failure to timely set out signs warning of a county road washout March 29, 2017.

The lawsuit, which seeks more than $125,000 for personal injuries and lost wages, among other damages, is set for jury trial Dec. 11 in Kingfi sher County District Court, with Blaine County Associate District Judge Allison Lafferty presiding.

Lafferty was assigned to the case after Kingfi sher County Associate District Judge Lance Schneiter recused himself early this year.

After her appointment, Lafferty ruled in February to deny the county’s motion for summary judgment, which had been fi led last December.

Pretrial motions from both sides are scheduled to be heard Nov. 14.

In other business the board approved declaring a 2005 Chevrolet pickup truck used by the engineer’s office as surplus, a change order for asphalt overlay on NS 2700 Road with B&S Construction and Trucking, a revised Kingfisher County application permit, an agreement to continue designating Circuit Engineering District 8 for engineering services and reappointing District 2 Commissioner Ray Alan Shimanek as its representative on the CED8 board and the following county road pipeline crossing permits:

• Targa Resources – 16-inch steel gas line located six miles west and one mile north of Okarche, District 3. The permit had been tabled previously but all issues have since been resolved, District 3 Commissioner Heath Dobrovolny said in moving for approval. Shimanek and District 1 Commissioner Jeff Moss joined him in voting yes for the action.

• Chisholm Oil and Gas Operating – 12-inch water line located four miles south and four miles west of Hennessey, District 2.

• Petro Land Services South – four-inch water line located one mile south and two miles east of Dover, District 2.

• Devon Energy Production – three 10-inch water lines in District 3 located as follow: six miles east of Omega, seven miles west and three miles north of Okarche and one mile north and five miles east of Omega.

• McDonald Land Services – two 12-inch water lines in District 3, one located two miles north and one mile east of Omega and one located one mile north and two miles west of Loyal.

Jay McChesney, attorney for The Williams Co. dealing with Bluestem Pipeline, LLC, and Jay Vincent of the Williams Co. public relations department attended the meeting on a get-acquainted visit.

County Clerk Jeannie Boevers served as minute clerk for the meeting.

Also attending the meeting were County Engineer Nik Smith and Pipeline Inspector Cody Murray.
