Court to hear arguments to stay mandate Friday
The U.S. Supreme Court will hear oral arguments Friday before deciding whether to pause the federal vaccine mandate for employers with more than 100 workers.
The court will not be ruling on the constitutionality of the OSHA emergency standard, but rather whether enforcement should be stayed while court challenges work their way through the appellate system.
A stay previouly implemented by the 5th Circuit Court of Appeals a day after the requirement was promulgated in November was lifted Dec. 17 by the 6th Circuit, which was assigned to hear all of the challenges to the mandate filed by states and various employers.
