Former KWN treasurer facing embezzling charge
A Kingfisher man faces possible jail time after allegedly embezzling more than $18,000 from Kingfi sher Winter Nights.
Timothy Shane Abercrombie, 41, was charged with a felony count of embezzlement last Thursday in Kingfisher County District Court.
Abercrombie turned himself in at the Kingfisher County Criminal Justice Center just before noon Monday and soon posted a $10,000 bond.
According to a probable cause affidavit signed by Sgt. Justin Trumbley of the Kingfisher Police Department, a recent review of the bank statements of Kingfisher Winter Nights showed 19 fraudulent transactions made between Jan. 24, 2022, and May 9, 2022.
Kingfisher Winter Nights is a Christmas lights display held annually at Kingfisher Park.
It is a non-profit 501(c) (3) organization and Abercrombie was listed as the organization’s treasurer from 2018 until March 27, 2024.
According to the affidavit, current Kingfisher Winter Nights President Chase Farrar stated, as treasurer, Abercrombie “was in possession of the debit card and checks for Kingfisher Winter Nights checking account.”
Eleven of the transactions in question were made at the Newcastle Casino and eight at Remington Park Racing & Casino, according to the affidavit.
All of the transactions plus their associated fees were listed as either “POS Payment” or “ATM/debit card debit,” according to the affidavit.
The total of the alleged fraudulent transactions was $18,028.90.
All of the transactions were made with the same debit card and on the affidavit was listed the last four digits of that card.
It goes on to state that InterBank records, where the accounts were set up, showed Abercrombie being issued the ATM/debit card with that specific number.
“This indicated that Tim was issued and responsible for the debit card…” according to the affidavit, adding that it was “never reported stolen and Tim never reported fraudulent charges on Kingfisher Winter Nights account.”
At the time the accounts were set up, Abercrombie was a vice president and loan officer at InterBank.
“We are aware of the investigations by the police and other authorities into an alleged breach of trust by one of our loan officers in Kingfisher,” said InterBank CEO C.K. Lee in a statement provided to the Times & Free Press.
“This loan officer is no longer employed by Inter-Bank. We have been fully cooperating with the authorities since we made them aware of this breach and we are also conducting our own internal investigation. We are committed to discovering the facts and minimizing the impact of this breach on our customers and the Kingfi sher community.”
Trumbley also makes note in the affidavit of a surety bond for Abercrombie written by Western Surety Company. The threeyear bond began June 27, 2019, and there was also a renewal bond that began June 27, 2022.
According to the affidavit, the bond lists Abercrombie as the treasurer of KWN and also lists required duties which included he make “all monthly, quarterly and annual reports to the (KWN) board.”
Also, according to the affidavit: “Tim never informed the board of $18,000 plus that was spent at casinos or reported his card missing or stolen…The Kingfisher Winter Nights board only found out about the fraudulent charges after taking it upon themselves to look at the bank statements.”
If convicted, Abercrombie faces up to eight years in the state penitentiary and a fine not to exceed $10,000 plus restitution.
