Kokojan trust dispute on special agenda

The Hennessey school board may vote to authorize the superintendent to sign agreements in the Raymond Kokojan Trust litigation in a special meeting at noon Tuesday.

The board is to first discuss the matter in executive (closed to the public) session with school attorney, Phyllis Walta. Kokojan amended his trust Jan. 4, 2012, so that the net income and principal of his substantial estate would go to the Hennessey Educational School Foundation for the benefit of Hennessey students.

Kokojan was a 1945 Hennessey High School graduate who died June 4, 2018.

His widow, Judith Kokojan, filed a lawsuit challenging the gift in October 2018 in Kingfisher County District Court.

The lawsuit alleges that Kokojan suffered from dementia and lacked the capacity to legally amend his trust.

His amended trust specifically excluded Mrs. Kokojan from any financial provisions after his death because “substantial gifts have been made to her during my life,” according to the trust language.

Prior to Kokojan’s amendment, the trust’s income and principal was to be divided equally between Mrs. Kokojan and Kokojan’s two children, according to Mrs. Kokojan’s petition.

District Judge Paul Woodward had ordered the parties to participate in formal mediation before the next court date in March.
