Pipeline company files lawsuits for easements

Navigator SMS Pipeline LLC has filed a number of lawsuits in Kingfisher County District Court to obtain easements from landowners for the first phase of its pipeline project.

The pipeline stretches from Calumet through the southwest corner of Kingfisher County and terminates in Cushing in Logan County.

State law provides a mechanism for private condemnation via lawsuit when parties can’t reach an agreement on easement purchases.

The process requires the appointment of three disinterested residents in each case to ascertain and assess estimated damages landowners may suffer to set a fair price for the easements.

According to petitions filed by Navigator SMS Pipeline, the company is seeking a perpetual 30-foot-wide easement across identified properties “for the purposes of constructing, installing, maintaining, operating, replacing, abandoning in place, inspecting, patrolling, protecting, testing, repairing, reconstructing, altering, relocating, changing the size of, removing and any and all uses” related to the pipeline and its associated equipment above and below ground.

The company also seeks the right to clear all trees and brush or other obstructions and restricting landowners from changing the elevation, planting trees or building a pond or building over the easement once the pipeline is installed, according to court documents.

Similar lawsuits have been filed in Canadian and Logan counties.

Some of the suits filed in this county have already been dismissed after the parties reached a settlement.
